Terms, Disclaimers & Limitation of Liability
1. Mandatory Customer Uninstallation & Reinstallation Policy
Under federal and state child passenger safety regulations, child restraint systems (car seats, booster seats, and LATCH anchors) must be installed strictly in accordance with manufacturer specifications. DetailSafe and its technicians are NOT certified Child Passenger Safety Technicians (CPST). Customer is strictly required to unbuckle, uninstall, and remove all child safety seats prior to detailing service and assumes 100% responsibility for properly reinstalling and tethering the seat afterward.
2. Absolute Shop Refusal of Seat Reinstallation Liability
If Customer leaves a child safety seat inside the vehicle cabin during interior service, Shop technicians will clean around or place the seat loosely inside the rear compartment upon service completion. Technicians will NEVER buckle, clip, cinch, or latch any child safety seat to vehicle tether anchors. Shop is fully released from liability for any improper seat installation, latch failure, or injury resulting from customer seat reinstallation.
3. Seat Weight Sensor & OCS Occupant Detection Warning
Modern passenger and rear seats contain delicate Occupant Classification System (OCS) weight sensors and seat belt pre-tensioners. While cleaning child seat indentations, chemical solutions are strictly controlled. Shop is not liable for pre-existing sensor faults or calibration warning lights triggered by aged factory wiring.
4. Non-Toxic, Baby-Safe Cleaning & Full Evaporation Period
Shop utilizes pH-balanced, non-toxic extraction detergents for child upholstery cleaning. Customer acknowledges that extracted fabrics must remain uninstalled and well-ventilated until 100% dry to touch before placing an infant or toddler back into the safety seat.
Pre-Service Authorization & Assent
Customer agrees to pre-service condition log, certifies removal of personal property, and agrees to all liability terms stated above.
Post-Service Handover & Satisfaction
Customer confirms visual satisfaction on finished surfaces upon pickup, subject to standard 48-hour discovery window.

Why Auto Detailers Need Specialized Liability Agreements
Standard generic waivers fail in small claims court and merchant chargeback disputes. Here is what makes this contract defensible.
The "Washed Dirt" Legal Precedent
When heavy road contamination and wax are stripped during washing and claying, deep scratches and clear coat failure are exposed. Without an explicit Washed Dirt disclosure, customers often presume the detailer created the defect during polishing.
Two-Stage Verification (Intake + Pickup)
Signing only at intake leaves you vulnerable to claims after the customer leaves. Capturing a post-service handover signature locks in customer satisfaction upon vehicle key return and sets a strict 48-hour discovery window.
Limitation of Financial Liability
In the event of a dispute, this clause caps maximum financial damages to the actual dollar amount paid for the detailing package, preventing disproportionate claims against small shops.
Bailment & Property Release
Protects technicians from claims regarding sunglasses, cash, radar detectors, or firearms inadvertently left in gloveboxes or trunk storage during thorough interior extractions.
Paper Waivers vs. DetailSafe Digital Shield
Paper sheets are a good starting point, but mobile detailing in wet driveways demands faster, tamper-evident digital proof.

Questions About This Agreement
Can auto detailers legally reinstall child car seats for customers?
Never reinstall a customer’s child car seat. If that vehicle is later involved in an accident and the seat was latched incorrectly, your detailing business can be held liable for catastrophic injuries. Always require the customer to reinstall and tether their own child seat.
What if a customer refuses to remove the car seat before an interior detail?
Have them sign this waiver. Clause #2 makes it clear that your technician will place the seat loosely in the car without clipping it into the LATCH anchors, placing the responsibility squarely on the parent.
