These Terms of Service ("Terms") govern access to and use of DetailSafe (the "Service"), provided by DetailSafe ("DetailSafe," "we," "us"). By creating an account, checking the acceptance box below, or using the Service, you ("Subscriber," "you") agree to be bound by these Terms. If you do not agree, do not use the Service.
DetailSafe is a software platform that helps auto detailing businesses generate pre-inspection and post-service documentation, including customizable liability waiver templates, for their own customers to review and electronically sign. DetailSafe is a software tool, not a legal service — see Section 8.
You must be at least 18 years old and have authority to bind the business you represent. You are responsible for the accuracy of your account information and for safeguarding your login credentials. You are responsible for all activity under your account, including that of your employees or staff you authorize to use it.
4.1 Billing via Lemon Squeezy. Paid subscriptions are processed by Lemon Squeezy, which acts as merchant of record for these transactions. When you subscribe, your purchase contract for the transaction itself is with Lemon Squeezy, under Lemon Squeezy's Terms and Buyer Terms; DetailSafe is the supplier of the software you're purchasing access to. Billing disputes, refund requests, and payment-method issues are handled through Lemon Squeezy's systems and support.
4.2 Fees & Renewal. Subscription fees, billing cycle, and any trial terms are as shown at checkout. Subscriptions renew automatically at the then-current rate until cancelled. You may cancel at any time; cancellation takes effect at the end of the current billing cycle.
4.3 Taxes. Sales tax, VAT, and GST on your subscription are collected and remitted by Lemon Squeezy as merchant of record. You remain responsible for any taxes related to your own business's use of the Service and the transactions you conduct with your customers.
5.1 Your Content. "Customer Content" means the data you input into the Service, including your business details, your customers' names, vehicle information, photographs, and electronic signatures collected through DetailSafe. You retain ownership of Customer Content.
5.2 Our Role. With respect to personal data of your customers that you collect through DetailSafe, you are the data controller and DetailSafe acts as a data processor / service provider acting on your instructions.
5.3 Your Responsibility. You are responsible for obtaining any consents required from your own customers to collect and process their data through the Service, and for the accuracy of the information you or your staff enter.

Waivers, disclosures, and other documents generated through the Service are customizable templates provided as a convenience. You are responsible for reviewing and adapting them to your business, your jurisdiction, and your specific services before use with your customers.
You will not: use the Service for any unlawful purpose; misrepresent your identity or business; attempt to reverse-engineer, scrape, or interfere with the Service; upload malicious code; or use the Service to collect data from individuals without a lawful basis to do so.
DetailSafe is a software tool, not a law firm, and does not provide legal advice. Nothing generated by the Service constitutes legal advice or a substitute for review by a licensed attorney in your jurisdiction. DetailSafe makes no representation or warranty that any generated document is enforceable in any specific jurisdiction. You are solely responsible for ensuring your use of the Service, and any documents you present to your customers, comply with the laws applicable to your business.
DetailSafe and its licensors own all right, title, and interest in the Service, including its software, design, and template library, excluding your Customer Content. Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable license to use the Service for your business's internal purposes.
The Service may integrate with or rely on third-party providers, including Lemon Squeezy for payments. Your use of those services is subject to their own terms. We are not responsible for the acts or omissions of third-party providers.
The Service is provided "as is" and "as available." To the maximum extent permitted by law, DetailSafe disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant the Service will be uninterrupted or error-free.
To the maximum extent permitted by law, DetailSafe's total liability arising out of these Terms or the Service shall not exceed the amount you paid for the Service in the three months preceding the claim. DetailSafe is not liable for indirect, incidental, or consequential damages, including any liability arising from a waiver generated through the Service later being found unenforceable. Nothing in this section limits liability that cannot lawfully be limited, including for gross negligence, willful misconduct, or fraud.
You agree to indemnify and hold DetailSafe harmless from claims arising from your use of the Service, your Customer Content, your failure to comply with applicable law, or disputes between you and your own customers.
We may suspend or terminate your access for breach of these Terms, non-payment, or unlawful use, with notice where reasonably practicable. You may terminate by cancelling your subscription. Upon termination, your right to access the Service ends; export your Customer Content beforehand, as we may delete it after a reasonable retention period.
These Terms are governed by the laws of Sri Lanka, without regard to conflict-of-laws principles. Disputes shall be resolved in the appropriate courts of Sri Lanka. This does not override any consumer protection rights you may have under the mandatory laws of your own country that cannot be waived by contract.
We may update these Terms from time to time. Material changes will be notified via email or in-app notice. Continued use of the Service after changes take effect constitutes acceptance.
